Prosecute all electoral offenses to serve as deterrent

Ghana conducted a successful General Election in 2024. However, all stakeholders must commit to upholding democratic principles and ensuring that electoral offenses are contained and prosecuted effectively.The call for stringent prosecution of electoral offenses is gaining momentum. Dr. Kwadwo Afari-Gyan, a former Chairperson of the Electoral Commission, has advocated for severe penalties for those who tamper with election processes, suggesting that such actions could be treated as treasonous. This perspective highlights the gravity of electoral offenses and underscores the necessity for legal frameworks that allow for swift and decisive action against violators.

This sentiment resonates with many citizens who are frustrated by the perception that perpetrators often escape accountability, particularly when party loyalty plays a role in shielding offenders from prosecution.

The National Election Security Task Force (NESTF) has been proactive in preparing for potential violence surrounding the elections. Their efforts to maintain order before and during the voting process have been commendable; however, there remains a pressing need for vigilance post-election as well. The police must not only contain violence but also ensure that those who commit electoral offenses face justice. This requires a robust framework that allows law enforcement to act decisively without undue bureaucratic hurdles, such as needing prior consent from the Attorney General to prosecute electoral crimes.

Political parties also bear responsibility for maintaining peace during elections. A code of conduct signed by major political parties aims to curb violence and promote adherence to democratic norms. However, this initiative must be backed by genuine commitment from party leaders to discipline their members and prevent any form of electoral misconduct.

 

Additionally, civil society organizations play a critical role in educating voters about their rights and the importance of reporting electoral offenses. Increased public awareness can empower citizens to hold officials accountable and foster an environment where electoral integrity is prioritized.
