Martin Amidu Declares Initial TCS Addendum Constitutionally Invalid

Martin Amidu has raised serious doubts about the legality of the original addendum to the TCS contract, asserting it was “void ab initio” and therefore could not have been subject to renegotiation as claimed by Finance Minister Dr. Ato Forson.

He pointed out that the addendum, signed on 4 November 2024 by former GRA Commissioner-General Julie Essiam, failed to comply with constitutional requirements.

“It lacked prior parliamentary authorization and was never presented to the last Parliament,” Amidu explained.

He rejected Dr. Forson’s claim that the parliamentary-approved agreement was merely a correction of that initial addendum.

“The Minister for Finance was being economical with the truth,” Amidu said.

He emphasized that the Constitution rendered the addendum invalid from the start, making any renegotiation legally impossible.

“The void addendum was not binding on the Government of Ghana under the Constitution and therefore could not be renegotiated,” he stressed.

Amidu further accused Dr. Forson of misleading the public by implying parliamentary approval was required because of obligations stemming from the earlier addendum.

“Ato Forson treated Ghanaians as if they were unthinking and lacking discernment,” he concluded.
